Terms of Service
This agreement, together with the Risk Disclosure and Privacy Policy below, governs your use of everything MDY Works provides. You accept it by signing it electronically on first sign-in. Please read it in full.
1. Who we are
The Service is provided by MDY Works ([legal entity name, legal form, registration number], registered office [business address]), contact [support email] ("MDY Works", "we", "us"). "You" means the individual who signs this agreement.
The "Service" means the website mdyworks.com and everything provided through it or with it: the trading algorithm and its deployment service, the Backtest Lab, the TradingView indicators, Ask MDY, the Discord community, documentation and support.
2. Eligibility
You may use the Service only if you: (a) are at least 18 years old and have full legal capacity; (b) use it for yourself and not on behalf of another person; (c) are not located in, ordinarily resident in, or a national of a country or region subject to comprehensive sanctions, and are not named on any sanctions list maintained by the United Nations, the European Union, the United Kingdom or the United States; and (d) are permitted to use it under the laws that apply to you. You are responsible for knowing and complying with those laws. You confirm that the information you give us when signing is true and complete.
3. Your access
Access is personal. Your access code binds to one device on first use and may be used by you only. Keep your access code, webhook URLs and any connected-account details confidential. You are responsible for all activity under your access. Tell us immediately at the contact address in section 1 if you believe your access has been compromised.
4. The Service
The Service is software and educational material. The algorithm applies one fixed, pre-defined set of entry and exit rules that is identical for every subscriber. If you choose to deploy it, our servers transmit order instructions generated by those rules to a webhook that you create in your own account with a third-party execution platform (such as TradersPost), which routes them to a broker account you connect.
You decide whether to deploy, which account to connect, and which of the settings we make available to use (for example account size, profit target, drawdown and contract limits). You may pause or stop deployment at any time from the Service or from your execution platform. We do not hold your funds, your broker or prop-firm login credentials, or trading authority over any account.
5. No investment advice; no adviser relationship
Nothing provided through the Service is investment, financial, legal or tax advice, a recommendation, or an offer or solicitation to buy or sell any financial instrument. All content and signals are impersonal and are not based on your personal financial circumstances or objectives.
MDY Works is not a broker, futures commission merchant, introducing broker, commodity trading advisor, commodity pool operator, investment adviser, investment firm, portfolio manager or fiduciary, and no advisory, fiduciary, agency, partnership or employment relationship exists between you and MDY Works. You are solely responsible for your trading decisions and their results. Consult a licensed professional if you need advice.
6. Intended use: evaluation and simulated accounts
The Service is designed and tested for proprietary-trading-firm evaluation accounts and simulated accounts.
Use of the Service on live-funded accounts, personal brokerage accounts or any account holding real capital is not advised and is not supported. If you connect such an account, you do so solely on your own decision and at your own risk, and MDY Works has no responsibility, obligation or relationship with respect to that account, its orders or its results.
7. Hypothetical and past performance
Hypothetical or simulated performance results have certain limitations. Unlike an actual performance record, simulated results do not represent actual trading. Since the trades have not been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity. Simulated trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profit or losses similar to those shown. Past performance, actual or simulated, is not indicative of future results.
How published figures are produced
- Source: recorded NQ futures order-book data from January 2025 to October 2026. Data from 2024 is not included in published figures. Half-days and market holidays are excluded.
- Rules simulated for published figures: Tradeify Select 50K rules ($3,000 evaluation target; $2,000 end-of-day trailing drawdown checked against intraday adverse moves, stopping at $50,100; best day at most 40% of profit; at least three trading days; funded $1,000 daily loss limit; $900 payouts above a $2,100 buffer) and $1 per MNQ round-trip cost. Entries are filled 0.5 points worse than the first print after the signal and stops 0.25 points beyond the stop.
- Method: an evaluation was started on each trading day in the data and run forward. Evaluations started on nearby days share most of their trades, so they are not independent results. The rules were selected using the same data.
- Live operation differs from the simulation in data timing, fills, slippage, latency and outages.
- Results you generate in the Backtest Lab with your own settings are your own hypothetical tests and are not published results of MDY Works.
8. Prop firms and third-party platforms
The Service works with platforms we do not own or control, including Whop, brokers and clearing firms, proprietary trading firms, TradingView, market-data vendors, hosting providers and AI model providers. Their own terms govern your use of them, and you must comply with them, including any rules on automated trading, signal services, copy trading, the same strategy being used by multiple traders, news trading and consistency. A proprietary trading firm may refuse, close or deny payouts on accounts for reasons including the use of automated or shared strategies; that risk is entirely yours.
We are not responsible for the availability, decisions, rule changes, order handling, fills, rejections, outages or errors of any third party. MDY Works is not affiliated with, endorsed by or sponsored by Whop, TradingView, TradersPost, Tradeify, Topstep, Tradovate, NinjaTrader, CME Group or any other firm named on the Service. All third-party names and marks belong to their owners and are used only to describe compatibility.
9. Licence and restrictions
Subject to this agreement and payment, we grant you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the Service for your own accounts, for the period you have paid for.
You must not, and must not allow or help anyone else to:
- share, sell, rent, lend or transfer your access, access code, deployment, webhook or indicator access;
- operate or deploy the Service on, for or on behalf of any account owned or controlled by another person, whether paid or free, including as a managed, "done-for-you" or account-passing service;
- copy-trade, mirror, rebroadcast, publish, resell or commercially exploit signals, orders or trades generated by the Service;
- copy, decompile, reverse-engineer, disassemble, scrape, record or reconstruct the rules, parameters, signals, code or data of the Service, including by systematically logging its output, or use them to build a competing product;
- circumvent device limits, access controls, rate limits or security, or interfere with the Service;
- use the Service unlawfully or in breach of any third party's terms.
10. TradingView indicators
Indicators are provided as invite-only scripts on TradingView. Access is managed through your Whop membership and granted to the single TradingView username linked there, only while your licence is active. Access may be revoked when your licence ends, on breach, or if a username is shared. You need your own TradingView account, and the terms and plan limits of Whop and TradingView apply. We do not control either platform and are not responsible for their availability or changes to their features.
11. Confidential information
The algorithm's rules, parameters, signals, trade output, indicator source, and any non-public documentation or communication you receive from us are our confidential information and trade secrets. You must keep them strictly confidential, use them only to operate the Service for your own accounts as permitted in section 9, and not disclose them to anyone. This obligation survives the end of this agreement without time limit. Because a breach causes irreparable harm, we may, in addition to any other remedy, end your access immediately without refund, claim full damages and seek injunctive or other urgent relief in any competent court.
12. Fees, renewals, refunds and taxes
Prices, billing periods and any renewal terms are shown at the point of sale. Prices may exclude taxes, which are charged where required. Access may be suspended if a payment fails.
Right of withdrawal. If you are a consumer in the European Union, the European Economic Area or the United Kingdom, you normally have a 14-day right of withdrawal from a purchase of digital content or services. When signing this agreement you expressly request that access begins immediately and acknowledge that you thereby lose that right once access has begun. A copy of your signed agreement is provided to you as confirmation.
Refunds. Except where a refund is required by law, all fees are non-refundable, including where access is ended because you breached this agreement.
Chargebacks. Filing a chargeback or payment dispute without first contacting us ends your access immediately. Chargebacks that we successfully contest may result in permanent exclusion from the Service.
13. Automation and technology risk
Automated trading depends on market data, servers, networks, webhooks, execution platforms, brokers and prop firms. Any of them can fail, be delayed or behave unexpectedly. Signals may be late, missed, duplicated or rejected; protective orders may not be placed, modified or cancelled as intended; positions may remain open. You are responsible for monitoring your account at all times, confirming that every order and protective order was placed as expected, and intervening yourself when necessary. We may pause deployment for all users at any time for safety reasons, including abnormal markets or technical problems. We do not guarantee uninterrupted, timely or error-free operation.
14. Community, testimonials and AI
Discord, social media posts and member results are opinions or individual experiences. They are not verified, are not typical, and are not a guarantee of any result. Ask MDY is an automated AI assistant; its answers may be inaccurate or incomplete and are not advice. You are responsible for content you post and must not post unlawful, misleading or infringing material or confidential information.
15. Intellectual property
All rights in the Service, including code, rules, parameters, indicators, designs, text, data and the MDY Works name and marks, belong to us or our licensors. No rights are granted except as expressly stated. If you send us feedback or suggestions, we may use them without restriction or compensation.
16. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, availability, profitability, or that any evaluation will be passed or any payout received.
17. Limitation of liability
To the fullest extent permitted by law: (a) MDY Works is not liable for any trading losses, lost profits, evaluation, reset or activation fees, lost or denied payouts, account closures, loss of data, or any indirect, incidental, special, consequential, exemplary or punitive damages, however caused and even if foreseeable; and (b) MDY Works' total liability for all claims arising out of or relating to the Service or this agreement, in contract, tort or otherwise, is limited to the fees you paid to MDY Works in the twelve (12) months before the event giving rise to the claim.
Nothing in this agreement excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, for intentional misconduct or gross negligence of our management, for death or personal injury caused by negligence, or your mandatory rights as a consumer.
18. Indemnity
To the extent permitted by law, you will defend, indemnify and hold harmless MDY Works and its owners, contractors and affiliates against all claims, losses, damages, fines, costs and expenses (including reasonable legal fees) arising from your use of the Service, your breach of this agreement, your breach of any law or third-party terms, or any use of the Service on an account other than your own, including claims by brokers, prop firms or regulators.
19. Suspension and termination
You may stop using the Service at any time. We may suspend or end your access immediately, without notice and without refund, if you breach this agreement, if required by law or a regulator, or to protect the Service or other users. On termination your licence and any indicator access end. Sections 7, 9, 11 and 13 to 23, and the Risk Disclosure, survive termination.
20. Changes to the Service and this agreement
We may change, add or remove features of the Service. We may update this agreement; the current version and its version date are always published at mdyworks.com/terms.html. If a change materially affects your rights, we will ask you to accept the new version before you continue using the Service, and you may stop using it instead.
21. Governing law and disputes
This agreement and any dispute arising from it are governed by the laws of the Netherlands, excluding the United Nations Convention on Contracts for the International Sale of Goods. The competent courts of the Netherlands have exclusive jurisdiction, except as stated below.
If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you live, and you may bring proceedings in the courts of that country where the law gives you that right.
To the extent permitted by the law that applies to you, claims may be brought only in your individual capacity and not as a plaintiff or class member in any class, collective or representative proceeding, and you waive any right to a jury trial.
22. Electronic signature and records
You agree that typing your full legal name and confirming acceptance is your electronic signature, that it has the same effect as a handwritten signature, and that this agreement is concluded electronically. We keep a record of your signature consisting of the name, email address and country you enter, the agreement version, the date and time, your IP address and browser information. You may download a copy of the signed agreement at the time of signing and may request another copy at any time.
23. General
If any provision is held invalid or unenforceable, the remaining provisions stay in force and the invalid provision is replaced by a valid one that comes closest to its purpose. This agreement, with the Risk Disclosure and Privacy Policy, is the entire agreement between you and us on its subject. You may not assign or transfer it; we may assign it to a successor of our business. We are not liable for failures caused by events beyond our reasonable control. A failure to enforce a right is not a waiver of it. If this agreement is translated, the English version prevails.
Risk Disclosure
Trading futures involves substantial risk of loss and is not suitable for every person. You may lose all the money you commit to an evaluation, account or trade and, with leveraged instruments, more than your initial deposit. Only use money you can afford to lose.
- Leverage. Futures are leveraged. Small price moves produce large gains or losses. Micro E-mini Nasdaq-100 futures (MNQ) can move many points within seconds.
- Gaps and slippage. Markets can gap, halt or move through stop orders, so a loss can exceed the planned stop distance.
- Prop-firm rules. Evaluation and funded-account rules (drawdown, consistency, contract limits, automation policies) can end an account regardless of profit or loss.
- Technology. Automation adds the risks in section 13 of the Terms of Service.
- Hypothetical results. See section 7 of the Terms of Service. No result shown is a promise of any future result.
